19874 9/18, 9/25/26 ORDINANCE NO. 2026-105 AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF PAYSON, ARIZONA, ADOPTING CERTAIN INTERNATIONAL CODES, WITH LOCAL AMENDMENTS THERETO, TO SERVE AS THE TOWN'S BUILDING REGULATIONS AND FIRE CODE. WHEREAS, the Town of Payson desires to amend sections of the Town's Building Regulations and Fire Code (Payson Town Code Chapter 150); and, WHEREAS, the Town of Payson has found that the adoption of this Ordinance is necessary for the protection of the health and safety of the citizens of the Town of Payson as a lawful exercise of police powers vested in the Town; and, WHEREAS, certain International Codes and local amendments thereto were declared to be public records pursuant to Town of Payson Resolution No. 2026-032; and, WHEREAS, it is the desire of the Mayor and Town Council to amend the Payson Town Code by reference pursuant to A.R.S. § 9-802. NOW, THEREFORE, THE MAYOR AND COUNCIL OF THE TOWN OF PAYSON, ARIZONA, ORDAIN AS FOLLOWS: Section 1. Adoption by Reference. Pursuant to A.R.S. §§ 9-801 and 9-802, the following public record declared by Resolution No. 2026-032 are hereby adopted by reference as if fully set forth in this Ordinance: 1. 2024 International Building Code (IBC). 2. 2024 International Residential Code (IRC). 3. 2024 International Mechanical Code (IMC). 4. 2024 International Plumbing Code (IPC) 5. 2024 International Fuel Code (IFC). 6. 2024 International Existing Building Code (IEBC). 7. 2024 International Property Maintenance Code (IPMC). 8. 2024 International Swimming Pool & Spa Code (ISPSC). 9. 2023 National Electrical Code (NEC). 10. 2024 International Fire Code (IFC). 11. Associated Referenced Standards and Local Amendments (Exhibit A to this Resolution) Section 2. Payson Town Code Amendments. That the newly adopted International Codes shall amend, replace and supersede Title XV, Chapters 150.20 (International Residential Code); 150.21 (International Building Code); 150.22 (National Electric Code); 150.23 (International Mechanical Code); 150.24 (International Fuel Gase Code); 150.25 (International Plumbing Code); 150.26 (International Existing Building Codes); FIRST READING AND PUBLIC HEARING AUG 1 2 2026 SECOND READING AND PUBLIC HEARING SFP 092026 F.1. A. see Res 2026-032 150.27 (International Swimming Pool and Spa Code); and 150.45 (International Fire Code). Section 3. Local Amendments Adopted. That the local amendments to the International Codes declared to be Public Records in Exhibit A to Resolution No. 2026-032 are hereby adopted by reference and shall be placed in the Town Code as appropriate. Section 4. Penalties. Any person violating this Chapter (Building Regulations and International Fire Code) or the Codes adopted under this Chapter shall be guilty of a separate offense for each and every day or portion of every day during which any violation is committed, continued or permitted. Such violations shall be punished pursuant to Section 10.99 of Title 1 of the Payson Town Code. Section 5. Severability. The provisions of this Ordinance, the Building Regulations and Fire Code adopted into the Town Code by this Ordinance, and the public records adopted by reference by this Ordinance are severable. If any section, subsection, paragraph, sentence, clause, phrase, or portion of this Ordinance, the Building Regulations and Fire Code adopted into the Town Code, or any public record adopted by reference is declared invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions. The Town Council declares that it would have adopted this Ordinance, the Building Regulation and Fire Code adopted into the Town Code, and the public records adopted by reference without the invalid or unconstitutional provision. Section 6. Codification. The Town Clerk, Town Manager, and Town Attorney, and their duly authorized designees, are authorized to take all actions necessary to publish, post, certify, file, index, and codify the Town Code and related documents. The Town Clerk and Town Attorney may make non-substantive formatting, numbering, cross-reference, typographical, and clerical corrections for codification, provided such corrections do not alter substantive meaning or effect. Section 7. Conflict. All ordinances or parts of ordinances that conflict with the provisions of this Ordinance are repealed to the extent of such conflict.
