19784 7/7/2026 Publication for CE Projects (floodplain/wetlands) E-P.3 - NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS AND NOTICE OF DECISION REGARDING PROJECT TO BE LOCATED IN (OR THAT WILL IMPACT ON) A FLOODPLAIN OR WETLANDS July 7, 2026 Name of Responsible Entity (RE) Star Valley Address: 3675 E Highway 260 City, State, Zip Code: Star Valley, AZ 85541 Telephone number of Preparer RE Agency (928) 472-7752 REQUEST FOR RELEASE OF FUNDS On or about July 15, 2026 the Town of Star Valley will submit a request to the Arizona Department of Housingvelopment for the release of FY2025 CDBG funds under Title I of the Housing and Community Development Act of 1974, to undertake a project known as Water Infrastructure Improvements for the purpose of: using approximately $156,800 of CDBG funds to complete the removal and replacement of failing water lines on Orion Drive and Mars Lane located in Star Valley, AZ. Further, in order to comply with Executive Orders 11988 or 11990 and the Water Resources Council's Floodplain Management/Wetlands Protection Guidelines, the Town of Star Valley hereby states that this Water Infrastructure Improvement Project lies within an identified floodplain or wetlands (or will impact on a floodplain or wetlands). However, the Town of Star Valley reached a decision that this is the only practicable alternative for this project. Its decision is based on an evaluation of the following alternative(s): no alternatives were considered as the project consists of minor repairs to existing infrastructure that does not disturb the floodways capacity. The Town of Star Valley will, however, ensure that this project will conform to all state and/or local floodplain or wetlands protection standards, and will take the following actions to mitigate the flood hazard/impact on wetlands and to restore and preserve natural and beneficial values: The water lines have never been replaced and are beginning to fail as they are between fifty and sixty years old. All work is taking place in the existing footprint of the water lines to ensure that no damage or redirection of the floodway occurs and no disturbance to the floodways capacity will occur and no additional impermeable surfaces will be added. The activities proposed are Categorically Excluded under HUD Regulations at 24 CFR Part 58 from National Environmental Policy Act requirements. For owner occupied rehabilitation projects, pursuant to 24 CFR 58.15, a specific review of the following items will be conducted on each proposed structure to be rehabilitated prior to beginning construction, and mitigation or project denial will be implemented as necessary: Historic Preservation, Airport Clearzones, Explosive and Flammable Operations, Toxic/Hazardous Materials, Contamination, Chemicals or Gasses; and Lead Based Paint. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at Central Arizona Governments; 2540 W. Apache Trail, Suite 108; Apache Junction, AZ 85120 and may be examined or copied weekdays 8 A.M. to 5 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the Central Arizona Governments; Angela Gotto; agotto@cagaz.org. All comments received by July 14, 2026 will be considered by the Town of Star Valley prior to authorizing submission of a request for release of funds. ENVIRONMENTAL CERTIFICATION The Town of Star Valley certifies to Arizona Department of Housing that Bobby Davis in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. Arizona Department of Housings approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Town of Star Valley to use Program funds. OBJECTIONS TO RELEASE OF FUNDS Arizona Department of Housing will consider objections to its release of funds and the Town of Star Valley certification received by July 15, 2026 or for a period of fifteen days following its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Town of Star Valley ;( b) the Town of Star Valley has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by Arizona Department of Housing; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to Arizona Department of Housing at 1110 W. Washington St., STE 280, Phoenix AZ 85007.
