19659 2/6, 2/13/26 ORDINANCE NO. 2026-101 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF PAYSON, ARIZONA, AMENDING PAYSON TOWN CODE TITLE XI (BUSINESS REGULATIONS), CHAPTER 111 (PEDDLERS AND SOLICITORS) SECTION 111-04 (APPLICATION FOR LICENSE). THE MAYOR AND COMMON COUNCIL OF THE TOWN OF PAYSON, ARIZONA, DO HEREBY ORDAIN AS FOLLOWS: Section 1. Payson Town Code Title XI (Business Regulations), Chapter 111 (Peddlers and Solicitors) Section 111-04 (Application for License) is amended as follows: (A) Individual Applicants. *(8)The fingerprints of the applicant. FINGERPRINTS SHALL BE SUBMITTED IN A FORM APPROVED BY THE TOWN POLICE DEPARTMENT. THE FINGERPRINTS SHALL BE SUBMITTED TO THE STATE DEPARTMENT OF PUBLIC SAFETY TO BE USED TO OBTAIN A STATE AND FEDERAL CRIMINAL RECORDS CHECK IN ACCORDANCE WITH A.R.S. § 41-1750 AND PUBLIC LAW 92-544. THE STATE DEPARTMENT OF PUBLIC SAFETY IS AUTHORIZED TO EXCHANGE THIS FINGERPRINT DATA WITH THE UNITED STATES FEDERAL BUREAU OF INVESTIGATION. and-The names of at least two reliable property owners of the town who will certify as to the applicant's good character and business responsibility, or, in lieu of the names of references, any other available evidence as to the good character and business responsibility of the applicant as will enable an investigator to properly evaluate character and business responsibility. (B) Corporate or firm applicants. (6) A list of all of the agents or representatives who will be operating within the town, including their addresses. In this connection, the firm or corporation shall furnish at the time of application the following information and material pertaining to representatives or agents: (b) The fingerprints of each agent or representative. FINGERPRINTS SHALL BE SUBMITTED IN A FORM APPROVED BY THE TOWN POLICE DEPARTMENT. THE FINGERPRINTS SHALL BE SUBMITTED TO THE STATE DEPARTMENT OF PUBLIC SAFETY TO BE USED TO OBTAIN A STATE AND FEDERAL CRIMINAL RECORDS CHECK IN ACCORDANCE WITH A.R.S. § 41-1750 AND PUBLIC LAW 92-544. THE STATE DEPARTMENT OF PUBLIC SAFETY IS AUTHORIZED TO EXCHANGE THIS FINGERPRINT DATA WITH THE UNITED STATES FEDERAL BUREAU OF INVESTIGATION, and The names of at least two reliable property owners of the town who will certify as to each person's good character and business responsibility or, in lieu of the names of references, any other available evidence as to the good character and business responsibility of the agents or representatives concerned as will enable an investigator to properly evaluate character and business responsibility. Section 2. Except as expressly amended by this Ordinance, the Payson Town Code remains in full and force and effect. Section 3 If any portion of this Ordinance is held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance.
