WHEREAS, Section 33.02 of the Payson Town Code requires any member who serves on a board, committee or commission to be a qualified elector of the Town of Payson; and WHEREAS, the Town Council seeks to allow non-residents to serve on the Building Advisory Board if the person resides in the surrounding area of the Town of Payson within the Payson Regional Justice Court Judicial District; and owns a business or property in the Town. 19768 6/19, 6/26/26 ORDINANCE NO. 2026-103 AN ORDINANCE OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF PAYSON, ARIZONA, APPROVING A ZONE CHANGE (CASE NO. P25-003) FROM R1 - 8-MH (SINGLE-FAMILY RESIDENTIAL WITH MANUFACTURED HOUSING OVERLAY) TO PLANNED AREA DEVELOPMENT (PAD) FOR APPROXIMATELY 83.73 ACRES LOCATED AT 1 300 W. LONGHORN ROAD; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Town of Payson has adopted zoning regulations to promote the orderly development of land and to protect the public health, safety, and welfare; and WHEREAS, Capital Investments LLC, through its agent EPS Group, IncF , submitted an application (Case No. P25 -003 ) requesting a Zone Change from R1 -8 -MH to Planned Area Development (PAD) for approximately 83373 gross acres located at 1300 W. Longhorn Road, identified as APNs 304-01 -3 72A (portion of), 304-01 -3 72C, 304-01 -3 72D, 304-01 -3 72M, and 304-01 -3 72P; and WHEREAS, the subject property is currently zoned R1 -8 -MH, and the proposed Planned Area Development (PAD) zoning is intended to establish a master planned community known as Longhorn Ranch, consisting of single-family attached, single-family detached, multi-family, and mixed-use/commercial development areas, as more particularly described in the attached Exhibit A (legal description), Exhibit B (site plan), and Exhibit C (project narrative); WHEREAS, the Planned Area Development (PAD) zoning district is intended to provide a flexible zoning framework that allows for coordinated, comprehensive development of large or complex sites, including a mix of land uses, integrated open space, circulation, and design elements; WHEREAS, the Planning and Zoning Commission held a duly noticed public hearing on April 6, 2026, and recommended approval of the requested Zone Change, subject to conditions; and WHEREAS, the Town Council held a duly noticed public hearing in accordance with Arizona Revised Statutes and the Town of Payson Unified Development Code; and WHEREAS, the Town Council has considered the application, staff report, public testimony, and applicable review criteria, and finds that the proposed PAD zoning provides for a more integrated and flexible development pattern than conventional zoning, supports a mix of housing types and neighborhood-serving commercial uses, and is compatible with surrounding land Uses; and WHEREAS, the Town Council further finds that the requested rezoning is contingent upon approval of the associated Minor General Plan Amendment (Case No. P25 -002) to ensure consistency with the Future Land Use Map; WHEREAS, the Town Council finds that the approval of this rezoning is in the best interest of the public health, safety, and welfare of the Town of Payson. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND TOWN COUNCIL OF THE TOWN OF PAYSON, ARIZONA, AS FOLLOWS: SECTION 1. APPROVAL The Zone Change identified as Case No. P25 -003 is hereby approved to rezone approximately 83.73 acres of property located at 1 300 W. Longhorn Road from R1-8-MH to Planned Area Development (PAD), as generally depicted on Exhibits A, B and C, which Exhibits are attached hereto and fully incorporated herein by reference, and in the applicant’s submitted materials. SECTION 2. CONDITIONS OF APPROVAL This approval is subject to the following conditions: 1. Approval of the PAD rezoning shall be contingent upon approval of the concurrent Minor General Plan Amendment (P25 -002) for Parcel 4. 2. Development of the property shall be in substantial conformance with the applicant’s submitted PAD narrative, conceptual land use plan, and PAD site plan, except as modified by these conditions or subsequent Town approvals. 3. The PAD shall apply only to the property identified in the application materials for Longhorn Ranch, consisting of approximately 83.73 gross acres. 4. Any subdivision plats, civil improvement plans, drainage reports, utility plans, traffic-related improvements, and other development submittals shall comply with all applicable Town requirements and shall be subject to separate review and approval. 5. All future development within the PAD shall comply with the development standards, design guidelines, and permitted use framework established in the approved PAD documents, except as otherwise amended through a future public process. 6. A homeowners association shall be established for the residential portions of the development, and CC&Rs addressing maintenance of common areas and facilities shall be submitted to the Town prior to recordation of subdivision plats. 7. Commercial development within Parcel 4 shall provide appropriate buffering, setbacks, and screening where adjacent to residential development, consistent with the approved PAD standards. 8. Any future substantial amendment to the PAD, including land use distribution, density, major circulation changes, or development standards, shall require review and approval in accordance with Town procedures. SECTION 3. SEVERABILITY If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. SECTION 4. EFFECTIVE DATE This Ordinance shall become effective thirty (30) days after its adoption by the Town Council.
