16468: 11/17/2017 NOTICE OF AVAILABILITY DRAFT RAY LAND EXCHANGE / PLAN AMENDMENT SUPPLEMENTAL ENVIRONMENTAL IMPACT STATEMENT The Bureau of Land Management (BLM), Gila District, Tucson Field Office, announces the availability of the Draft Supplemental Environmental Impact Statement (EIS) for the Ray Land Exchange / Plan Amendment and by this notice is announcing its availability and opening of the comment period. BLM prepared this Draft Supplemental EIS to analyze a proposed land exchange with ASARCO LLC, a mining company, which would exchange 10,976 acres of BLM managed federal land (Selected Lands) near or adjacent to the Ray Mine Complex and Copper Butte properties operated by ASARCO near Kearny, Arizona in Pinal and Gila Counties. The BLM would acquire 7,304 acres in exchange on 18 parcels (Offered Lands) in Pinal and Mohave Counties. The original Ray Land Exchange Final EIS was issued by the BLM in 1999, and was approved on April 27, 2000. After 10 years of appeals and legal challenges, the Ninth Circuit Court of Appeals held that a major premise of the environmental impact analysis contained in the 1999 Final EIS was flawed. The Supplemental EIS is being put forth to satisfy the court opinion on a "with or without" analysis of public lands subject to the BLM's surface use regulations at 43 CFR 3809.
