19275 11/12, 11/19/24 ORDINANCE NO. O 24-02 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF STAR VALLEY, ARIZONA, AMENDING THE TOWN CODE OF STAR VALLEY, ARIZONA, BY REPEALING ORDINANCE NO. O 07-04 (ARCHITECTURAL DESIGN REVIEW COMMISSION) AND ORDINANCE NO. O 07-16 (ARCHITECTURAL DESIGN REVIEW GUIDELINES) AND ADOPTING BY REFERENCE THAT CERTAIN DOCUMENT ENTITLED AMENDMENTS TO STAR VALLEY TOWN CODE, TITLE 2 (BOARDS AND COMMISSIONS), CHAPTER 4 (COMMUNITY BETTERMENT COMMITTEE; REPEALING ANY CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Star Valley Town Ordinance O 07-04, an ordinance of the Town of Star Valley, Arizona, established the Architectural Design Review Commission on March 6, 2007; and WHEREAS, the Town of Star Valley (hereinafter referred to as the Town) adopted Ordinance O 07-16, Town of Star Valley Architectural Design Review Guidelines on February 7, 2008 establishing guidelines to apply to proposed commercial and multi-family projects, including new projects, additions, renovations, remodels and other related requiring building permits; and WHEREAS, on September 17, 2024, the Town Council discussed changes to the purpose and scope of the Architectural Design Review Commission and the Architectural Design Review Guidelines and requested Town Attorney Grier to review Ordinance O 07-04 and Ordinance O 07-16 and draft an ordinance to establish a five (5) person Community Betterment Committee to replace the Architectural Design Review Commission and the guidelines set forth in the Architectural Design Review Guidelines; and WHEREAS, the purpose of the Community Betterment Committee is to recommend innovative ideas and projects to the council that would beautify and enhance the Towns image; and WHEREAS, the Community Betterment Committee is a recommending not regulatory body. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF STAR VALLEY, ARIZOA AS FOLLOWS: Section I. General. That certain document known as Amendments to Star Valley Town Code, Title 2 (Boards and Commissions), Chapter 4 (Community Betterment Committee) at least three paper copies or one paper copy and one electronic copy of which are accessible on the towns website and filed in the office of the town clerk, which document was made a public record by Resolution No. R 24-10 of the Town of Star Valley, is hereby referred to, adopted and made a part hereof as if fully set out in this ordinance, pursuant to A.R.S. § 9-802. Ordinance No. O 24-02 Page 2 Section II. Repealing Any Conflicting Provisions. The following Town of Star Valley Code Sections are hereby repealed: Star Valley Town Ordinance No. O 07-04, an ordinance of the Town of Star Valley, Arizona, establishing the Architectural Design Review Commission on March 6, 2007; and Star Valley Town Ordinance No. O 07-16, an ordinance of the Town of Star Valley, Arizona, establishing guidelines on February 7, 2008 to apply to proposed commercial and multi-family projects, including new projects, additions, renovations, remodels and other related requiring building permits. All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the codes adopted herein by reference, are hereby repealed. Section III. Providing for Severability. If any section, subsection, sentence, clause, phrase or portion of this ordinance or any part of the codes or regulations adopted herein by reference, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof. Section IV. Effective Date. The effective date of this Ordinance shall be thirty (30) days following adoption by the Town Council.
