19767 6/19, 6/26/26 ORDINANCE NO. 2026-102 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF PAYSON, ARIZONA, AMENDING PAYSON TOWN CODE TITLE III (ADMINISTRATION), CHAPTER 33 (BOARDS, COMMITTEES AND COMMISSIONS) SECTION 33.35 (FORMATION; MEMBERSHIP) RELATING TO THE BUILDING ADVISORY BOARD; AND PROVIDING FOR SEVERABILITY. WHEREAS, Section 33.02 of the Payson Town Code requires any member who serves on a board, committee or commission to be a qualified elector of the Town of Payson; and WHEREAS, the Town Council seeks to allow non-residents to serve on the Building Advisory Board if the person resides in the surrounding area of the Town of Payson within the Payson Regional Justice Court Judicial District; and owns a business or property in the Town. THE MAYOR AND COMMON COUNCIL OF THE TOWN OF PAYSON, ARIZONA, DO HEREBY ORDAIN AS FOLLOWS: Section 1. Payson Town Code Title III (Administration), Chapter 33 (Boards, Committees and Commissions) Section 33.35 (Formation; Membership) is amended as follows: BUILDING ADVISORY BOARD § 33.35 FORMATION; MEMBERSHIP. (A) There is hereby established a Building Advisory Board. (B) The members of the Building Advisory Board shall be qualified by training and experience to act on matters pertaining to building construction and the construction and fire safety codes adopted by the town. NOTWITHSTANDING SECTION 33.02 OF THIS CODE MEMBERS OF THE BOARD ARE NOT REQUIRED TO BE QUALIFIED ELECTORS OF THE TOWN OF PAYSON PROVIDED THAT SUCH MEMBERS WHO ARE NOT QUALIFIED ELECTORS OF THE TOWN (1) RESIDE WITHIN THE PAYSON REGIONAL JUSTICE COURT JUDICIAL DISTRICT; AND (2) OWN A BUSINESS OR ENTERPRISE WITHIN THE TOWN OF PAYSON, OR OWN REAL ESTATE WITHIN THE TOWN OF PAYSON. Section 2. Except as expressly amended by this Ordinance, the Payson Town Code remains in full and force and effect. Section 3. If any portion of this Ordinance is held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance.
